Mediation

Chisolm, Esq. provides neutral or evaluative mediation services, depending upon the parties’ election. Both approaches are designed to facilitate resolution by identifying each party’s true objectives, and by helping the parties to communicate with each other about what they want to achieve and to explore compromises that will lead them to a mutually acceptable and binding resolution of the dispute. If parties elect to use the evaluative approach, the mediation process will also involve frank discussions about the merits of the case. Mediator Tuneen Chisolm will listen intently to each party and consider their unique identity to adapt the mediation process as needed to deliver an appropriately customized, confidential mediation experience to help you reach a satisfying resolution of your dispute.

Arbitration

Chisolm, Esq. provides arbitration services designed to resolve conflicts in a more expeditious and cost-efficient manner than the court process generally affords. Parties have a voice in specific procedural aspects, but are encouraged to limit discovery and certain other contours of traditional litigation. Where appropriate, Parties may elect to have their matter decided via submission of briefs and written evidence in lieu of an evidentiary hearing. In either instance, the path to a full resolution is streamlined. Our approach is consistently fair, informed, and decisive. Arbitrator Tuneen Chisolm is available for arbitrations administered through the American Arbitration Association or independently.

Neutral Case Evaluation

Chisolm, Esq. provides neutral case evaluation services, which can assist a single party or opposing parties with assessing the strengths and weaknesses of their case, with no associated risks. Through this process, you will receive a detailed, advisory opinion on the matter submitted. The process is particularly helpful in complex litigation, when parties desire a non-binding determination on critical issues that will provide context for settlement discussions. Neutral case evaluation can focus on a critical aspect of the case or on a broader evidentiary motion. Neutral Tuneen Chisolm will thoroughly assess the merits of your dispute at the trial or appellate level, based upon your submitted written briefs, evidence, the court record (where appropriate), and oral argument (if requested).

Special Master and Discovery Referee Services

Chisolm, Esq. provides special master and discovery referee services for parties to pending court cases, where the parties desire to expedite the court process and achieve resolution of interim issues without possibly prejudicing the balance of their case before the presiding judge. These options are well-suited for particularly complex and/or contentious cases. Special Master Tuneen Chisolm is available to serve upon appointment by the presiding judge for matters currently pending in state and federal courts, as local rules allow. Discovery Referee Tuneen Chisolm is available to resolve discovery disputes ranging from questions arising during depositions to motions to compel. In either instance, decisions will be made on the merits, as warranted by the law and facts.
